Terms and Conditions
Introduction
These terms and conditions (the “Terms”) govern your use of the services and products offered by Treehouse Adoptions, a community and animal welfare-focused organisation dedicated to the welfare and adoption of birds. By accessing or using our services, including bird adoption, bird rehoming, the Buddy Program, or our online store, you agree to comply with these Terms. If you do not agree to these Terms, please refrain from using our services.
2. Definitions
- Adopter: An individual or entity who applies to adopt a bird from Treehouse Adoptions.
- Rehomer: An individual or entity who seeks to rehome a bird through Treehouse Adoptions.
- Buddy Program: A financial assistance initiative to help adopters rehome birds with the aid of subsidies or discounted services.
- Services: Any services provided by Treehouse Adoptions, including but not limited to bird adoption, rehoming, the Buddy Program, and product sales through the online store
3. General Terms and Conditions
These Terms apply to all interactions with Treehouse Adoptions, including but not limited to bird adoption, bird rehoming, participation in the Buddy Program, and the purchase of products via the Treehouse Adoptions online store.
4. Bird Adoption
4.1 Adoption Process
Treehouse Adoptions facilitates the adoption of birds to suitable homes. While we endeavour to match birds with appropriate adopters, due to the varying histories and behavioural characteristics of each bird, we cannot guarantee the compatibility of any particular bird with an adopter.
4.2 Animal Backgrounds and Risks
Adopters acknowledge that birds available for adoption may have unknown or incomplete backgrounds, including prior health conditions, behavioural issues, or traumatic experiences. Treehouse Adoptions is not liable for any injuries, damages, or losses arising from the adoption or interaction with the bird.
4.3 Adoption Decision and Liability Waiver
The decision to adopt a bird is solely that of the adopter. Treehouse Adoptions provides assessments to assist in the process but disclaims liability for any injuries, damages, losses, or costs resulting from the adoption. By adopting a bird, adopters accept full responsibility for their interactions with the bird.
4.4 Administrative Contribution
A small non-refundable administrative contribution is required to assist with our operational costs. This contribution is not refundable if the adoption is unsuccessful or if the bird is returned.
4.5 Meet and Greet Sessions
Treehouse Adoptions facilitates meet-and-greet sessions between potential adopters and birds, but we are not responsible for the conduct or outcomes of these sessions. Adopters acknowledge that interactions during these sessions are at their own risk.
4.6 Photographs and Media Usage
By submitting photographs or media content to Treehouse Adoptions, adopters grant Treehouse Adoptions a non-exclusive, royalty-free, perpetual right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with Treehouse Adoptions’ promotional and educational activities.
4.7 Indemnification
Adopters agree to indemnify and hold Treehouse Adoptions, its officers, directors, employees, agents, and volunteers harmless from any claims, damages, losses, or expenses arising from the adoption process or interactions with the birds.
4.8 Modification of Terms
Treehouse Adoptions reserves the right to modify these Terms at any time, without prior notice. Any modifications will take effect immediately upon posting on the Treehouse Adoptions website.
5. Bird Rehoming Services
5.1 Rehoming Process and Facilitator Role
Treehouse Adoptions facilitates the rehoming of birds by acting as an intermediary. We do not make the final decision regarding the rehoming of a bird. Rehomers (the individuals offering the birds for rehoming) are responsible for assessing potential adopters and ensuring compatibility.
5.2 Rehoming Fee
A fee is charged for the rehoming process to cover administrative and operational costs. This fee is non-refundable, regardless of whether the rehoming is successful or if the bird is returned.
5.3 Animal Backgrounds and Risks
Birds available for rehoming may have unknown or incomplete backgrounds, including prior health conditions, behavioural issues, or traumatic experiences. Both rehomers and adopters acknowledge that interactions with rehomed birds carry inherent risks. Treehouse Adoptions disclaims liability for any injuries, damages, or losses arising from such interactions.
5.4 Rehoming Decision and Liability Waiver
Treehouse Adoptions does not make the final decision regarding the suitability of a bird for rehoming. It is the responsibility of the rehomer and adopter to ensure compatibility. Treehouse Adoptions is not liable for any outcomes related to the rehoming process or the behaviour of the bird.
5.5 Meet and Greet Sessions
Treehouse Adoptions helps manage the logistics of meet-and-greet sessions by confirming dates and times, and providing the address and contact information. However, we are not part of these sessions. These sessions are arranged and conducted solely by the rehomers and potential adopters. Treehouse Adoptions relies on both parties to provide feedback on the suitability of the match.
5.6 Administrative Contribution
A non-refundable administrative contribution is required to help cover the costs of the rehoming process, including the bird’s care, transport, and any necessary veterinary checks. This contribution is not refundable, even if the rehoming process is unsuccessful or the bird is returned.
5.7 Indemnification
By participating in the rehoming process, both rehomers and adopters agree to indemnify and hold Treehouse Adoptions harmless from any claims, damages, or losses arising from the rehoming process or interactions with the birds.
5.8 Modification of Terms
Treehouse Adoptions reserves the right to modify or discontinue the rehoming services at any time, without prior notice.
6. The Buddy Program
6.1 Eligibility
The Buddy Program provides support to bird owners, offering resources and guidance to help ensure birds receive the necessary care, particularly in relation to critical veterinary care.
6.2 Financial Assistance
Treehouse Adoptions may provide partial financial assistance for veterinary care, primarily for critical treatments. The amount of assistance is determined at the discretion of Treehouse Adoptions, based on available funds and individual circumstances. Treehouse Adoptions does not guarantee full coverage of veterinary expenses.
6.3 Support Beyond Financial Aid
In addition to financial assistance, the Buddy Program provides guidance and access to resources to assist bird owners in providing the best possible care for their birds. This may include behavioural advice, dietary guidance, and training resources.
6.4 Contributions to the Program
Approx. 5% of all sales from the Treehouse Adoptions online store are allocated to the Buddy Program. Donations may also be made directly to the Buddy Program, and donations made in celebration or memory of a pet will be acknowledged where applicable.
6.5 No Guarantees or Liabilities
Treehouse Adoptions does not guarantee the outcome of any veterinary treatments funded through the Buddy Program. By applying for assistance, applicants acknowledge that Treehouse Adoptions is not liable for the results of any veterinary procedures.
6.6 Program Changes
Treehouse Adoptions reserves the right to modify or discontinue the Buddy Program at any time, without prior notice.
7. Online Store
7.1 Product Availability and Description
Treehouse Adoptions offers a range of bird-related products via our online store. We endeavour to ensure accurate descriptions and pricing of products, but we do not guarantee the accuracy of such information. Product details, pricing, and availability may change without notice.
7.2 Product Use and Responsibility
Purchasers acknowledge that the products sold are intended for use as described in the product descriptions. Treehouse Adoptions is not responsible for the misuse or improper application of any product.
7.3 No Warranty or Guarantee
Treehouse Adoptions provides no warranties or guarantees, express or implied, for any products purchased through the online store, including but not limited to suitability, effectiveness, safety, or quality. All products are sold as-is.
7.4 Returns and Refunds
Returns and refunds are not generally accepted. If a product is received damaged or defective, please contact Treehouse Adoptions within 7 days to discuss the issue. Refunds or replacements will be considered on a case-by-case basis.
7.5 Shipping and Delivery
Treehouse Adoptions ships products as promptly as possible, but shipping times may vary. The relevant carrier will handle all shipping issues, and Treehouse Adoptions is not responsible for delays or damages during delivery.
7.6 Indemnification
By purchasing from the online store, you agree to indemnify and hold Treehouse Adoptions harmless from any claims, damages, or losses arising from the use of products purchased, including injury, property damage, or other liability.
8. Privacy and Data Protection
8.1 Collection and Use of Personal Data
We collect and process personal data in accordance with the Privacy Act 1988 and the Australian Privacy Principles. The data collected is used solely for the purposes of facilitating the adoption process, the rehoming of birds, and the sale of products.
8.2 Data Sharing
We may share personal data with third parties (such as veterinarians) for the purpose of ensuring the health and safety of the birds under our care. We will not sell or lease your personal data to third parties.
8.3 Data Security
Treehouse Adoptions takes reasonable steps to protect the security of your personal information. However, we cannot guarantee the security of data transmitted over the internet.
8.4 Your Rights
You have the right to access, correct, and request the deletion of your personal data held by Treehouse Adoptions. For more information, please refer to our Privacy Policy.
9. Limitation of Liability
9.1 General Disclaimer
To the fullest extent permitted by law, Treehouse Adoptions will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury or property damage, arising from the adoption, rehoming, or use of products purchased from Treehouse Adoptions.
9.2 Liability Cap
Treehouse Adoptions’ total liability for any claims arising under these Terms and Conditions will be limited to the amount paid by you for the adoption, rehoming service, or product in question.
10. Force Majeure
Treehouse Adoptions will not be held liable for failure or delay in the performance of its obligations under these Terms and Conditions due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, strikes, or supply chain disruptions.
11. Termination of Services
11.1 Termination by Treehouse Adoptions
Treehouse Adoptions reserves the right to suspend or terminate services if the adopter or rehoming party violates these Terms and Conditions, engages in illegal activity, or fails to meet the necessary responsibilities related to the care of the bird.
11.2 Termination by Adopter/Rehomer
Adopters or rehoming parties may terminate their agreement with Treehouse Adoptions by providing written notice. The administrative contribution will remain non-refundable.
12. Dispute Resolution and Jurisdiction
12.1 Arbitration
In the event of a dispute, we encourage you to contact us directly for resolution. If a dispute cannot be resolved informally, both parties agree to submit to arbitration before pursuing litigation.
12.2 Jurisdiction
These Terms and Conditions will be governed by and construed in accordance with the laws of South Australia. Any disputes arising out of or related to these Terms and Conditions will be subject to the exclusive jurisdiction of the courts in South Australia.
13. Age Restrictions
By engaging with Treehouse Adoptions’ services or purchasing products, you confirm that you are at least 18 years of age. If you are under 18, you may only use these services with the involvement of a parent or guardian.
14. Changes to Terms and Conditions
Treehouse Adoptions reserves the right to amend or update these Terms and Conditions at any time. We will provide notice of any changes by posting the updated version on our website. Your continued use of our services following such changes constitutes your acceptance of the revised terms.
